This appeal was considered on the record from the United States District Court for the District of Columbia and on the briefs filed by the parties. The court has determined that the issues presented occasion no need for an opinion. See D.C.Cir.Rule 36(b). It is
ORDERED AND ADJUDGED that the district court's order entered October 12, 1993, be affirmed. Under Local Rule 211 of the Rules of the District Court for the District of Columbia, which embodies the principles of Rule 41(b) of the Federal Rules of Civil Procedure, the district court did not abuse its discretion by dismissing appellant's complaint with prejudice for failure to prosecute. See Smith-Bey v. Cripe, 852 F.2d 592, 593-94 (D.C.Cir.1988).
The Clerk is directed to withhold issuance of the mandate herein until seven days after disposition of any timely petition for rehearing. See D.C.Cir.Rule 41.
