65 F3d 177 United States v. Umali
65 F.3d 177
UNITED STATES of America, Plaintiff-Appellee,
Rodrigo Jaurique UMALI, Defendant-Appellant.
United States Court of Appeals, Ninth Circuit.
Submitted Aug. 16, 1995.*
Decided Aug. 22, 1995.
NOTICE: Ninth Circuit Rule 36-3 provides that dispositions other than opinions or orders designated for publication are not precedential and should not be cited except when relevant under the doctrines of law of the case, res judicata, or collateral estoppel.
Before: ALARCON, FERNANDEZ and RYMER, Circuit Judges.
Rodrigo Jaurique Umali appeals his sentence under the Sentencing Guidelines imposed following his guilty plea conviction for conspiracy to sell firearms to a felon. Umali contends that the district court improperly denied his request for a downward departure on the ground that his criminal history category overrepresented his misdemenor conviction for nonsupport. We lack jurisdiction to review the district court's discretionary refusal to depart downward. See United States v. Heim, 15 F.3d 830, 833 (9th Cir.), cert. denied, 115 S.Ct. 55 (1994).
