The Court

¶1arrested the judgment on the ground that the inform*22ation stated that the penalty accrued to the Commonwealth. By the act of incorporation of Alexandria', all penalties for breaches of by-laws were to be for the use of the town, and to be levied by distress and sale of the offender’s goods.
