¶1To compel respondent to issue a summons, under Act No. 460, Local Acts 1895, where the amount, the recovery of which is sought, exceeds $300.
¶2The circuit judge denied the writ, holding the act unconstitutional.
¶3Reversed and writ granted October 8, 1895, without costs.
