¶2THE bond upon which this action is sounded, is executed by one partner for himself and the others. He has no power, merely as a partner, to execute a bond, which shall be obligatory upon the rest of the firm. The case of Harrison versus Rushforth, in 7 Term Rep. is a conclusive authority to this effect ; and the reasoning upon which it is founded seems to be unanswerable.
