Bailey, J.

¶1The facts in this record bring the case precisely within the rule laid down in Schmidt v. Slcelly, decided at the present term [ante, 561], and upon the authority of that case, and of the cases there cited, the judgment will be reversed and the cause remanded.

¶2Judgment reversed.
