“If the jury believe, beyond a reasonable doubt, that the defendant . . . fraudulently, designedly, knowingly and falsely represented to [the victim] . . . that he had not assigned his claim . . . , and that he was the owner of the order, when in truth and in fact he was not, and that by reason thereof he obtained the order from [the victim], he must be guilty.
