¶1Mahoning C.P. No. 03CR535. This cause is pending before the court as a death penalty appeal from the Court of Common Pleas of Mahoning County. On May 19, 2005, counsel for appellant filed a suggestion of death indicating that appellant is deceased. Accordingly,
