““The instructions given were of more than usual length and appear to cover every conceivable phase of the crime of which the defendant was charged. Under the established rule, the instructions must be considered as a whole, Russell v. Sunburst Refining Co., 83 Mont. 452 , 72 P. 998 ; State v.
