¶1 (concurring).
¶2 I concur in all that is said in the opinion of Mr. Justice McDONOUGH. But I have grave doubts as to whether an action such as this properly lies under the Declaratory Judgments Act. The question is not raised so we do not enter into any discussion thereof. The opinion is not to be taken as lending color to the propriety of such proceeding were the question raised.
