• Andrew S. Stone and others recovered in this court on the 30th day of January, 1858, a judgment against Bufus Sanger (the defendant above named) for $3,389.19, on which an execution was issued, and returned unsatisfied.

Sutherland, J., dissenting.

¶1In this case the order at special term should be reversed, with $10 costs on the appeal and $10 costs of opposing the motion below to the appellants.

¶2In my opinion it is a clear case.

¶3The statement on which the judgment in this action was entered by confession was, in my opinion, abundantly sufficient.

¶4Order affirmed.
