¶1While I cannot concur in all the statements of law in the opinion of the majority of the court, I concur in the result.
¶2So long as we maintain the system of forms of actions which we have inherited from England, and by which justice is so often sacrificed to mere technicalities, we must hold that an action of trover cannot be sustained in a case like the present.
¶3Judgment for the defendant for his costs.
