Hall v. Wagner

Appellate Division of the Supreme Court of the State of New York · decided 1906-02-09

Appeal by the defendants, Otto Wagner and others, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 30th day of March, 1905, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 19th day of April, 1905, •denying the defendants’ motion for a new trial made upon the minutes.

¶2I dissent on the ground that it- was error to receive Hall’s testimony in contradiction of Weyaht’s. •

Houghton, J.

¶3(dissenting):

¶41 dissent on the ground that the objection was not sufficient to raise the question of Weyant’s competency as a witness, the-objection being to the competency of the evidence merely.

¶5Judgment and order affirmed, with costs.
