1. The term "heirs" means those persons who succeed to an intestate's property. 2. A widow is not an "heir" as thus defined, but may take an interest in her deceased husband's real estate by waiver of dower or homestead under RSA ch. 560, and not as an heir under the statute of descent and distribution (RSA <cross_reference>561:1</cross_reference>). 3. The second wife was not the heir of her husband within the meaning of the provision of his first wife's will that devised property to him for life with the right at his death to dispose of the same by will "among his heirs or my heirs, and in default of appointment equally to my next of kin, [as] if I should then die intestate, and to his next of kin at his death"; and his purported devise of the property to his second wife not being an effective exercise of the power granted to him by his first wife's will, the property belonged to his and his first wife's "next of kin" as provided by her will. 4. The first wife's use of the words "next of kin" in her will signified an intention that, in the event of her husband's intestacy, the property would pass to the "next of kin" as provided by RSA <cross_reference>561:1</cross_reference>.
