¶1For the reasons stated in my opinion in the case of Burns v. McAdoo (113 App. Div. 173) I dissent. I think the order appealed from should be affirmed. -

¶2Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs. Order filed.
