¶1 I concur in the result announced in the foregoing opinion, but not with all that is said in it. I think it is improper for *490 this court to attempt to weigh conflicting evidence or to determine what issues were established by the preponderance of the evidence. The question of the weight of the evidence and of the preponderance thereof is exclusively for the jury.
