Windtcs, J.:

¶1I cannot agree to an affirmance of this judgment. The affidavits clearly show there was a new verbal agreement between the parties, and- not a holding over under the terms of the original lease. This new agreement is void under the Statute of Frauds, and appellant should have been allowed to plead.
