¶1concurring .specially. I would feel bound by Powell v. Berry, 145 Ga. 696 (89 SE 753, LRA 1917A 306) and leave the issue for a jury to determine, except for the reason in the case sub judice the plaintiff affirmatively placed the control and operation of his vehicle in the hands of the defendant who had-had several drinks.
