¶1Cuyahoga App. No. 90618. This ease was filed by appellant as an appeal of right pursuant to S.Ct.Prac.R. II(1)(A)(1). However, upon review it is determined that this case originated in the court of common pleas and should proceed as a discretionary appeal.
¶2It is ordered that appellant shall file a memorandum in support of jurisdiction pursuant to S.Ct.Prac.R. Ill no later than January 10, 2008.
