¶1Upon consideration of the motion of counsel for appellant, it is
¶2Ordered that the appeal in this cause commenced by notice of appeal filed in the Criminal Court of Record for Hillsborough County, Florida, on January 21, 1959, be and the same is hereby dismissed.
