¶1concurring specially.
¶2Because of other law involved in this case, I am constrained to concur in the judgment of reversal. However, I cannot agree fully with what is said in Division 1 of the opinion. The majority of the whole court has expressed the law on the question in Sloan v. State, 115 Ga. App. 852 (156 SE2d 177).
