<bold>Automobiles and Other Vehicles § 487 (NCI4th) — intersection accident</bold> <bold>—</bold> <bold>directed verdict improper</bold> In an action for damages arising out of an automobile accident, the trial court erred in directing verdict for defendant where the evidence tended to show that plaintiff entered an intersection after observing defendant's automobile approaching and determining that he had sufficient time to cross and that defendant, who could see the intersection as he approached, hit plaintiff's automobile just as it cleared the intersection, since this evidence was sufficient for submission to the jury on several theories of<page_number>Page 236</page_number> negligence, including that plaintiff failed to keep a proper control of his automobile, operated his auto at a speed greater than reasonable and prudent under the conditions, and failed to decrease his speed when approaching and entering an intersection. <bold>Am Jur 2d, Automobiles and Highway Traffic § 798</bold>.

<bold>Searches and Seizures § 7 (NCI4th) — officer's questions and request</bold> <bold>to</bold> <bold>frisk — no unreasonable search and seizures</bold> A police officer's questioning and request to frisk defendant who had just flown into Raleigh from New York did not constitute a seizure within the purview of the Fourth Amendment right against unreasonable searches and seizures, and the Court therefore need not decide whether the officer had reasonable suspicion to believe defendant was armed and involved in criminal activity when he initiated the pat frisk. <bold>Am Jur 2d, Searches and Seizures §§ 10 et seq</bold>.
