SYLLABUS BY THE COURT 1. CONTRACTS — <italic>Agreement to Execute Lease — When Agreement</italic> <italic>Required to Be in Writing to Comply with Statute of Frauds.</italic> An agreement to execute a lease is within the statute of frauds if the lease the parties contemplate entering into is within the statute of frauds; therefore, to be valid, that agreement to execute must be in writing. 2. SAME — <italic>Written Agreement — Modifications to Agreement Must</italic> <italic>Be in Writing.</italic> If an agreement is within the statute of frauds and must be in writing to be enforceable, any substantial modification of the agreement, to be enforceable, must likewise be in writing and signed by the party to be charged therewith. 3. ATTORNEY FEES — <italic>Statutory Authorization — Trial Court</italic> <italic>Discretion — Appellate Review.</italic> In Kansas, attorney fees are not allowed unless authorized by statute or by agreement of the parties. The amount of attorney fees to be awarded is a matter largely within the trial court's discretion and will be overturned only upon a showing of an abuse of discretion. 4. CONTRACTS — <italic>Attorney Fees — Contractual Provision to Award</italic> <italic>Fees to "Prevailing Party" — Recovery of Damages Not</italic> <italic>Prerequisite to Award of Fees.</italic> A contractual provision allowing the "prevailing party" to collect attorney fees does not require the recovery of damages before attorney fees may be awarded.
