Lotz v. Levy

Appeal by the defendant, Simon Levy, from a judgment of the Supreme Court in favor of the plaintiffs, entered in the office of the clerk of the county of Kings on the 30th day of November, 1906, upon the verdict of a jury rendered by direction of the court after a trial at the Kings County Trial Term.

¶1,The letters between the parties do not show,that the defendant employed the plaintiffs, or that they produced a purchaser. ' They^ could not require the defendant to come to New York to meet proposed purchasers'; it was for them to produce, a purchaser tb him.

¶2■ The judgment should be reversed.

¶3Woodward, Jenks, Hooker and Rich, JJ., concurred.

¶4Judgment reversed, and new .trial granted,Acosts to abide the.' event. .
