¶1concurring in part and dissenting in part:
¶2I concur in the result reached by the majority. I disagree, however, that the questioning of Gaxiola concerning his failures to recant his admittedly false statements to police before and after his arrest violated his Fifth Amendment right to remain silent. Thus, in my view, it was unnecessary to engage in a harmless error analysis on this issue.
