““Kotwithstanding you may believe that some of the entrymen may, at the time they made their entries, have had an intention not to live on the land embraced therein, the fact that they had no intention to live thereon is not material for your consideration in determining whether or not the defendants were acting fraudulently, unless you find that such intention not to live on the land was actually known to the defendants before or at the time such entry was made.
