<bold>[1] Constitutional Law — Contracts — Impairment — State and</bold> <bold>Federal Provisions.</bold> The federal and state prohibition against laws impairing the obligation of contracts (U.S. Const. art. 1, § 10; Const. art. 1, § 23) have the same effect. <bold>[2] Constitutional Law — Contracts — Impairment — Public and</bold> <bold>Private Contracts.</bold> A law impairing the obligation of a public contract is subject to more stringent scrutiny under the constitutional prohibition against the impairment of the obligation of contracts (U.S. Const. art. 1, § 10; Const. art. 1, § 23) than is a law regulating contractual relationships between private parties. <bold>[3] Port Districts — Contracts — Status.</bold> A port district's contracts qualify as public contracts. <bold>[4] Constitutional Law — Contracts — Impairment — Public</bold> <bold>Contracts — Test.</bold> Legislation impairs a public contract if: (1) a contractual relationship exists; (2) the legislation substantially impairs the contractual relationship; and (3) the impairment is not reasonable and necessary to serve a legitimate public purpose. <bold>[5] Constitutional Law — Contracts — Impairment — Public</bold> <bold>Contracts — Substantial Impairment — Bonds — Effect on</bold> <bold>Value.</bold> The fact that legislation affects the value or rating of an outstanding government bond is not sufficient, by itself, to prove that the legislation impairs the obligation of a contract in violation of U.S. Const. art. 1, § 10 or Const. art. 1, § 23. <bold>[6] Constitutional Law — Contracts — Impairment — Public</bold> <bold>Contracts — Substantial Impairment — Bonds — Test.</bold> Legislation substantially impairs the contractual relationship<page_number>Page 147</page_number> between a governmental body and its bondholders if the legislation detrimentally affects the financial framework that induced the bondholders originally to purchase the bonds without providing alternative or additional security. <bold>[7] Constitutional Law — Contracts — Impairment — Public</bold> <bold>Contracts — Reasonable and Necessary — Police Power.</bold> Legislation that substantially impairs a public contractual relationship violates U.S. Const. art. 1, § 10 and Const. art. 1, § 23 unless the legislation serves a legitimate public purpose and is reasonable and necessary to achieve the public purpose. The legitimate public purpose requirement ensures that the legislation effectuates the government's police power, rather than merely providing a benefit to a special interest. <bold>[8] Port Districts — Annexation — Less Than County-Wide District</bold> <bold>— Statutory Provisions — Validity.</bold> A less than county-wide port district's annexation of adjacent territory that is in a second less than county-wide port district and is within the limits of a city that forms part of the name of the annexing port district, as authorized by RCW 53.04.082, unconstitutionally impairs the obligation of general obligation bonds issued by the second port district.
