Bingham, as police commissioner of the city of New York, and others, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of Mew York on the 14th day of February, 1908, continuing a temporary injunction pendente lite.

¶1The question presented on this appeal is the same as that presented in the casez of Shepard v. Bingham (125 App. Div. 784), decided herewith, and for the reasons there stated the order appealed from is reversed, with ten dollars costs and disbursements, and the motion for an injunction denied, with ten dollars costs.
