¶1Upon consideration of the stipulation of counsel for the respective parties, it is
¶2Ordered that the appeal in this cause commenced by notice of appeal filed in the Office of the Clerk of the Circuit Court for Hillsborough County, Florida, on December 12, 1960, be and the same is hereby dismissed, without prejudice.
