¶1(concurring in part and dissenting in part).

¶2I concur in denying Clay C. Slagle’s motion to “disqualify” Special Justice Bernard Harwood. I continue to agree with Justice Shaw’s well reasoned special writing issued on original submission; therefore, I dissent from the overruling of the application for rehearing.

SHAW, Justice

¶4I concur in denying Clay C. Slagle’s motion to “disqualify” Special Justice Har-wood; I adhere to my dissent in this matter issued on original submission, and I therefore dissent from the overruling of the application for rehearing.
