Most-quoted passages
The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 5 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.
“Rule 8.04(A)(3) of the Uniform Circuit and County Court Rules provides that[,] before the trial court may accept a plea of guilty, the court must determine that the plea is voluntarily and intelligently made and that there is a factual basis for the plea. A sufficient factual basis requires an evidentiary foundation in the record [that] is sufficiently specific to allow the court to determine that the defendant’s conduct was within the ambit of that defined as criminal. We review the entire record to discern whether a sufficient factual basis exists.”
1 later decision quote this exact passage“A defendant can establish a factual basis for a guilty plea simply by pleading guilty; however, the guilty plea must contain factual statements constituting a crime or be accompanied by independent evidence of guilt. In other words, a factual basis is not established by the mere fact that a defendant enters a plea of guilty. Finally, an appellate court is not limited to a review of a defendant's plea transcript when determining if a factual basis existed for a guilty plea.”
