MR. CHIEF JUSTICE ADAIR:

¶1(specially concurring).

¶2I concur in the result but not in all that is said in the foregoing opinion. It is clear to me that the accused was not accorded a fair trial to which he was and is entitled under our Constitution, and his court appointed attorney is to be commended for bringing this appeal to our attention.
