¶1Upon consideration of the motion filed in this cause by the attorney for the appellant and the motion filed by the attorney for the appellee, it is
¶2Ordered that the appeal in this cause commenced by notice of appeal filed in the Criminal Court of Record for Hillsborough County, Florida, on February 7, 1961, be and the same is hereby dismissed.
