¶1 concurring in part and dissenting in part.

¶2 Unquestionably, Congress made clear its intent to allow a serviceman to select the beneficiary of his own government life insurance policy regardless of state law, but such legislation was not designed to overlook or ignore fraud or misrepresentation. Where the undisputed facts reveal a clear departure from the manifest purpose of such legislation, the law is not helpless to do that which in fairness ought to be done.
