<bold>1. Schools and School Districts — Nature and Purpose</bold> A town school is a corporate entity, separate and distinct from the town. <bold>2. Taxation — Appraisal and Assessment — Jurisdiction</bold> In fiscal matters a town school district is not entirely independent of the town; the school district decides how much money it needs and how that money shall be used, and town sets tax rate and manages collection of taxes. <cross_reference>16 V.S.A. § 428</cross_reference>. <bold>3. Taxation — Appraisal and Assessment — Jurisdiction</bold> Where town school district assessed tax on appraisal card value instead of grand list value it was in error, for grand list of town was in essence also that of town school district, and the latter was bound by it. <cross_reference>16 V.S.A. § 427</cross_reference>(a). <bold>4. Taxation — Grand List — Validity</bold> Grand lists are not subject to collateral attack when no statutory appeal has been taken from the appraisal of the listers and no suit to recover taxes paid under protest is entered before the grand list for that year is closed. 32 V.S.A. §§ 4155, 4157. <bold>5. Municipal Corporations — Contracts — Impairment</bold> Where town entered into valid tax stabilization contract, such contract was constitutionally protected from impairment by later acts of granting body or its political subdivisions, even if those subdivisions were independent corporations. <cross_reference>24 V.S.A. § 2741</cross_reference>.<page_number>Page 38</page_number> <bold>6. Taxation — Special or Favored Treatment — Stabilization</bold> <bold>Contract</bold> Housing project, the owners of which entered into a commercial property tax stabilization contract with town, had as its primary purpose the realization of income or profit and was thus commercial property within the meaning of statute allowing the contract. <cross_reference>24 V.S.A. § 2741</cross_reference>. <bold>7. Taxation — Appraisal and Assessment — School Districts</bold> Where housing project owner had, pursuant to contract, been granted five-year schedule of reduced value property tax by town, and town school district subsequently assessed full value tax, school district was in error, and the reduced value contract was binding upon it. <cross_reference>24 V.S.A. § 2741</cross_reference>.

<bold>1. Divorce — Custody and Support of Children — Amendment of</bold> <bold>Order</bold> To warrant modification of a child custody order made pursuant to a divorce, the petitioner must prove a substantial change in the material circumstances and that under the new conditions a change of custody is in the best interests of the child. <cross_reference>15 V.S.A. § 292</cross_reference>. <bold>2. Divorce — Custody and Support of Children — Environment</bold> In determining a child custody matter, a court has the duty of considering future harmful effects of an environment in which the child is to be brought up, both as to the moral and the physical upbringing of the child, and a change of custody need not be denied until such time as the petitioner can conclusively prove that harm has already occurred. <cross_reference>15 V.S.A. § 292</cross_reference>. <bold>3. Appeal and Error — Preservation of Questions — Failure to</bold> <bold>Present Below</bold> Evidence not objected to at hearing on petition for change of child custody could not be objected to on appeal. <bold>4. Divorce — Custody and Support of Children — Child's Wishes</bold> In a change of child custody proceeding, wishes of a child found to be opposed to the child's best welfare must yield. <cross_reference>15 V.S.A. § 292</cross_reference>.
