¶1 concurring in part and dissenting in part.
¶2 I concur in the first, second and third assignments of error. I would rule .upon the fourth assignment of error because this assignment of error is based upon the evidence presented at trial. The outcome of the first assignment of error will neither add to nor delete from the evidence and record that is now before us. Therefore, this assignment of error is ripe for decision.
