144 Wash. App. 1

Magee v. Rite Aid

Court of Appeals of Washington

Decided March 3, 2008

Court of Appeals of Washington · decided 2008-03-03

Decided 2008-03-03

Agid, J.

¶1¶32 (concurring) I agree with and have signed the majority opinion. And, while I have not verified the historic facts recited in the concurring opinion, I agree with it as well. I write separately to emphasize the need for legislative review of this aspect of the workers’ compensation statute. Marcia Magee should not be deprived of compensation because, although she tried, she was unable to comply with the procedural requirements of the statute.
