¶1dissenting.

¶2This case will create undesirable precedent for lowering the waiver age to twelve in Idaho. A professional evaluation committee determined that this young person should be treated as a juvenile. The subjective waiver evidence appears based primarily on the emotional circumstances. In my opinion the magistrate abused his discretion.
