DAVIDSON, C. J.

¶1Appellant was convicted of carrying a pistol. The record is before us without a statement of facts or bills of exception. The case might be affirmed, but for the fact the recognizance is insufficient under the statute; therefore the jurisdiction of this court is not attached. It fails to set out the punishment allotted appellant, as required by the statute.

¶2The appeal is dismissed.
