  1. “navigable waters.” 33 U.S.C. § 1344 (a). The CWA defines navigable waters as "the waters of the United States, including the territorial seas.” Id. § 1362(7). The Army Corps of Engineers and the Environmental Protection Agency, both of which enforce the CWA, have promulgated regulations defining waters of the United States.
