DAVIDSON, Judge.

¶1The appellant was convicted of the offense of cattle theft. Upon conviction, his punishment was fixed at two years in the state penitentiary.

¶2Appellant has filed affidavit advising this court that he does not further desire to prosecute his appeal.

¶3The appeal is dismissed at the request of appellant.
