SYLLABUS BY THE COURT 1. EQUITY — <italic>Division of Property of Parties Who Were Cohabiting</italic> <italic>but Not Legally Married.</italic> In dividing the property of parties who are cohabiting but are not legally married, either formally or by common law, a trial court, in the exercise of its inherent power to do equity, is authorized to make an equitable division of the property jointly accumulated by the parties or acquired by either with the intent that each should have an interest therein. 2. SAME — <italic>Division of Property of Parties Who Were Cohabiting</italic> <italic>but Not Legally Married — Principles of Partnership Law Not</italic> <italic>Applicable.</italic> In Making a division of property of parties who are cohabiting but are not legally married, the trial court is not bound by the Uniform Partnership Act, K.S.A. <cross_reference>56-301</cross_reference> <italic>et</italic> <italic>seq.</italic>, or required to apply principles of partnership law. 3. DIVORCE — <italic>Motion for Relief from Property Division Judgment</italic> <italic>— Trial Court Allowed to Grant New Trial or Modify Initial</italic> <italic>Decree That Was Based on Misunderstanding of Facts.</italic> A trial court has broad discretionary powers under K.S.A. <cross_reference>60-260</cross_reference>(b)(6) to grant a new trial and modify its initial decree of divorce to remedy an inequitable division of property which was based on a misunderstanding of the true facts. 4. CIVIL PROCEDURE — <italic>Relief from Judgment — Motion for Relief</italic> <italic>Need Not Specify Particular Ground for Relief.</italic> A motion for relief under K.S.A. <cross_reference>60-260</cross_reference>(b) need not specify one particular ground for relief. Assuming a party files a K.S.A. <cross_reference>60-260</cross_reference>(b) motion within a year of the entry of judgment, as was done in this matter, the trial court is authorized to grant relief for any of the reasons set forth in the statute.
