HARPER, J.

¶1Appellant was convicted of swindling, in an amount less than $50, a misdemeanor.

¶2There is neither a statement of facts nor bills of exception in the record. The only *711ground assigned in the motion for a new trial is, “because the verdict is contrary to the law and the evidence.” In the absence of a statement of facts there is nothing presented for review.

¶3The judgment is affirmed.
