Landlord and Tenant — Proceedings To Recover Rent — Waiver</bold> Landlord's acceptance of rent checks for less than the amount due did not constitute a waiver of its right under the lease to increase the rent by 10% upon default. <bold>2. Landlord and Tenant — Lease Agreement — Particular Cases</bold> Landlord did not waive its right to collect net profits from tenant's sublease by waiting too long before demanding payment where lease did not require landlord to demand payment of net profits at any specific time, delay by landlord was due to the fact that it did not learn of the termination of the sublease until three months after the termination, and it was reasonable for landlord to wait until expiration of the sublease. <bold>3. Landlord and Tenant — Lease Agreement — Particular Cases</bold> Lease provision allowing landlord to increase basic rent by 10% upon default was not unconscionable where both parties were sophisticated business persons acting with the assistance of able counsel.
