¶1 (concurring in result) : For the reasons stated in my dissenting opinion in the case of State v. Wells, upon the jury question involved, I would dissent in this case, but, since a majority of the Court have overruled the point raised in the Wells case, I feel constrained *86 to concur in the result of this opinion. Upon the other questions discussed herein, I concur.
