1. ““In Turner the defendant was arrested for D.W.I. While a police officer was driving defendant’s vehicle to the police station, he became aware of a beer bottle on the floor of the car. When he leaned over to pick it up, he noticed a bag of marijuana lying near the beer bottle. This Court held that. . . the marijuana was admissible . . . In Turner the police officer was legitimately inside defendant’s car to begin with. His discovery of the beer bottle and subsequent discovery of the marijuana was not because of an intent on his part to search the vehicle. Under the circumstances, what the officer did in Turner was reasonable; here it was not.””
