DAVIDSON, J.

¶1Appellant was convicted of a felony theft, his punishment being assessed at two years’ confinement in the penitentiary.

¶2The appeal is before us without a statement of facts or bills of exception. In the absence of a statement of facts and bills of exception, the matters set out in the motion for new trial are not reviewable.

¶3As the record is presented the judgment will' be affirmed.
