Sutherland, J.

¶1I dissent from the conclusion at which Judge Leonard has arrived. The last request to charge is so obscure, that I do not know what the prisoner’s counsel meant by it. I do not know what he meant by the words, “ independent of any complicity between that Brown and the defendant which was drawn into the case.”

¶2New trial granted.
