¶1There was no evidence that the instrument with which the assault was made was a deadly weapon; and in the absence of proof to this effect, the evidence as a whole sufficiently supported the charge of stabbing. The judge did not err in his charge to the jury, or in declining the several requests to give in charge the law touching assault with intent to murder. Judgment affirmed.
