¶2129 I agree with my colleagues that Hansen was illegally detained when the officer asked for permission to search his vehicle and conducted that search. I also agree that the trial court erred in determining that Hansen gave his clear and unequivocal consent to the search. Having made that determination, I would not undertake to analyze whether Hansen's non-consent was obtained without duress or coercion. I would therefore concur in the conclusion that the trial court erred in denying Hansen's motion to suppress.
